Di cosa parla

  • NLMs (National Liberation Movements) can be assisted, while rebels cannot; self-determination applies to situations of oppression.
  • Western Sahara case: Spain was forced by the UN to hold a referendum for self-determination, but Morocco blocked it. The ICJ ruled that Western Sahara was not terra nullius and confirmed UNGA's 1960 Declaration on colonial people. Despite this, no referendum has been organized.
  • EU-Morocco relations: The CJEU ruled that the EU cannot apply agreements to Western Sahara as it is not part of Morocco's territory. This decision was based on respecting UN principles and maintaining international law.
  • The ICJ in the Wall Case (OPT) ordered Israel to cease building the wall, provide reparations, and recognize self-determination as an erga omnes principle.
  • International Organizations: They can be subject to international law if independent and autonomous. The UN has the capacity to claim reparation for injuries suffered by its agents, based on its aims and competences established in the Charter.
  • The United Nations' broad aims allow it to develop rights and obligations under international law. It includes bodies like the General Assembly, Security Council, Secretariat, ECOSOC, and ICJ with specific competencies.
