- Private Law traditionally covers relations between private persons and includes Civil Law, Commercial Law, and Employment Law. Before 1942, there were separate Civil and Commercial codes; since then, both are included in the Civil code.
- The Italian Constitution is the supreme source of law, ensuring all laws comply with it. Private law protects individual interests, while Public Law deals with public interest relations between people and authorities.
- Private Law rules support private autonomy but can be non-mandatory or overriding. Judges apply these rules considering good faith, public orders, and morals. Legal relations involve active (rights, expectations, powers) and passive positions (duties, obligations).
